  1. Ownership of Service: Welcome to OTTOHM by Applied Cloud Computing Pvt. Ltd. The Ottohm websites (www.ottohm.com and any variations of or successors to these websites, collectively, the “OTTOHM Website” or the “Website”), OTTOHM applications (PLAYTV and any other applications made available by OTTOHM, collectively, the “OTTOHM Apps” or the “Apps”) and the OTTOHM service (together with the Website and the Apps, the “OTTOHM Service” or the “Service”) are owned by OTTOHM by Applied Cloud Computing Pvt. Ltd. and, from time to time, its subsidiary and affiliate corporations, successors, and assigns (collectively referred to as “OTTOHM”). The OTTOHM Service currently consists of various web pages at or linked to the Website, the Apps, as well as areas of numerous websites operated by other companies that have entered into an agreement with OTTOHM to publish their Content through the OTTOHM Service on their site. The OTTOHM Service may expand or change from time to time. 
  1. Acceptance: By using the OTTOHM Service and/or the Website or Apps, you agree, without limitation   or qualification, to be bound by, and to comply with, these Terms and conditions and any other posted guidelines or rules applicable to any website or App where the OTTOHM Service is found. OTTOHM may make improvements and/or changes to the Website or Apps at any time. Although we attempt to periodically update information on the Website and Apps, the information, materials and services provided on or through the Website and Apps may occasionally be inaccurate, incomplete or out of date. OTTOHM does not have a duty to update information contained in the Website or Apps, and OTTOHM will not be liable for any failure to update such information.
  1. License To Content: Except as otherwise provided by the OTTOHM Privacy Policy, with respect to any Content posted by you on, to, or through OTTOHM or the Services, you grant OTTOHM a world-wide, royalty free, perpetual, license to use, copy, transmit, publicly display, publicly perform, create compilations including, create derivative works of, and distribute such Content to publish and promote such Content in connection with the particular Services and to publish and promote such Content elsewhere within OTTOHM and the Services. Such license shall apply with respect to any form, media, or technology now known or later developed. 
  1. Limitation of Liability: You acknowledge and agree that OTTOHM and its licensors shall not be held liable to any user for any damages resulting from the user’s use, misuse, or reliance on the services provided by OTTOHM. This limitation of liability applies to prevent the recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages, even if OTTOHM or its licensors have been advised of the possibility of such damages. This limitation of liability also applies to damages incurred by third parties due to the use, misuse, or reliance on the services, or due to any interruption, suspension, or termination of the services. Furthermore, this limitation of liability applies to damages incurred as a result of using other services or goods received through or advertised on the services, as well as any information or advice received through or advertised on the services. It includes but is not limited to, internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.
  1. Termination: Use of the OTTOHM Service is subject to compliance with these Terms and Conditions. You acknowledge and agree that OTTOHM may terminate and/or suspend your access to any portion of the OTTOHM Service should you fail to comply with the Terms and Conditions or any other guidelines and rules published by OTTOHM. Any such termination or suspension shall be in OTTOHM’s sole discretion and may occur without prior notice, or any notice. OTTOHM further reserves the right to terminate or suspend any user’s access to OTTOHM or to any portion of the OTTOHM Service for any conduct that OTTOHM, in its sole discretion, believes is or may be directly or indirectly harmful to other users, to OTTOHM or its subsidiaries, affiliates, or business contractors, or to other third parties, or for any conduct that violates any local, state, federal, or foreign laws or regulations. OTTOHM further reserves the right to terminate or suspend any user’s access to the OTTOHM Service for any reason or for no reason at all, in OTTOHM’s sole discretion, without prior notice.

Intellectual Property Rights: The content available on the OTTOHM platform, excluding User Submitted Media, such as text, software, scripts, graphics, photos, sounds, music, videos, and interactive features (collectively referred to as “Content”), along with the trademarks, service marks, and logos displayed on the platform (“Marks”), are either owned by or licensed to OTTOHM. The Content provided on the OTTOHM platform is made available to you “AS IS” for informational and personal use purposes only. You are strictly prohibited from using, copying, reproducing, distributing, transmitting, broadcasting, displaying, selling, licensing, or exploiting the Content for any other purposes without obtaining prior written consent from the respective owners of the Content. OTTOHM reserves all rights not expressly granted in relation to the platform and its Content. By using the OTTOHM platform, you agree not to engage in the unauthorized use, copying, or distribution of any Content, including User Submitted Media from third parties obtained through the platform, for commercial purposes. If you choose to download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained within the Content. You further agree not to circumvent, disable, or interfere with any security-related features of the OTTOHM platform and its services, or any features that prevent or restrict the use or copying of the Content. This includes compliance with any limitations imposed on the use of the platform or its Content.
  1. Registration and Data Privacy: To access certain features of OTTOHM services, users are required to register and provide specific information. By registering and submitting such data, you affirm that (a) the information provided about yourself is truthful, accurate, up-to-date, and complete (excluding optional items) as required by OTTOHM registration forms (“Registration Data”), and (b) you will regularly update the Registration Data to ensure its accuracy and completeness. If you provide false, inaccurate, outdated, or incomplete information, or if OTTOHM has reasonable grounds to suspect so, OTTOHM reserves the right to suspend or terminate your account and deny any current or future use of the services. All registrations made on OTTOHM become the exclusive property of OTTOHM, its affiliates, successors in interest, and subsidiaries. OTTOHM retains the right to use and reuse all registration and personally identifiable user information, subject to the OTTOHM Privacy Policy. By using the service, you acknowledge that you have received and reviewed the OTTOHM Privacy Policy, including the Notice Regarding the Privacy of Children Under 16 while using OTTOHM Service. Users have the ability to edit, update, modify, or obscure their personally identifiable information at any time by following the instructions outlined in the OTTOHM Privacy Policy. For the parts of OTTOHM services that require registration, once you register, you will receive a password. It is your responsibility to keep your password and ID confidential, and you will be held fully accountable for all activities conducted under your password or ID. You agree to (a) immediately notify OTTOHM of any unauthorized use of your password, account, or any security breaches, and (b) ensure that you log out of your account at the end of each session. OTTOHM cannot and will not be held liable for any loss or damages resulting from your failure to comply with this requirement.
